1. Scope

These VPS Terms of Service apply to every Virtual Private Server ("VPS") bought through Helipod, whether from the dashboard, the API or MCP. They supplement Helipod's general Terms & Conditions and Fair Use Policy. Where they differ, these VPS terms apply to VPS services.

By buying, renewing or using a VPS, you confirm that you have read and agree to these terms.

2. VPS Types & Locations

Helipod offers three types of VPS. Technical rules (ports, traffic, service period) can differ by type and location, as summarised in the table above.

VPS, APP & Windows:

  • Locations: Jakarta (Indonesia), Singapore, Johor Bahru (Malaysia), Bangkok (Thailand), Tokyo (Japan), Seoul (South Korea) and Frankfurt (Germany)
  • Each VPS gets its own public IPv4 address
  • Each plan has a monthly outbound traffic allowance

VPS Core:

  • Locations: Germany and Singapore
  • Each VPS gets its own public IPv4 address
  • Traffic has no allowance and follows a fair-use principle

VPS EU (shared IP):

  • Location: Germany
  • The public IPv4 address is shared with other VPS on the same server
  • It is reachable from the internet only through the SSH port it is given, the port range allocated to your VPS, and the domains (HTTP/HTTPS) you connect in the dashboard

Your VPS data is stored in the country of the location you choose and is subject to the law of that country in addition to the law of the Republic of Indonesia.

By choosing a location outside Indonesia, you agree that the data you store on the VPS, including personal data you manage, is transferred to and processed in that country. You are responsible for ensuring that you have a valid legal basis for processing other people's personal data on your VPS under Indonesia's Personal Data Protection Law.

3. Payment, Renewal & Service Period

Payment:

  • A VPS is paid in advance from your Helipod wallet balance for 1, 3, 6 or 12 months
  • The price that applies is the price shown at the time of the transaction
  • Promotional discounts apply only to transactions that meet that promotion's conditions, once per person or small business unless stated otherwise. Using multiple accounts to obtain a promotion repeatedly may result in the promotion being cancelled and the price difference being charged
  • If a wallet top-up payment is cancelled, reversed (chargeback) or proven fraudulent, Helipod may suspend any VPS bought with that balance and charge the shortfall

Renewal:

  • If auto-renew is on, the renewal is taken from your wallet balance shortly before the period ends
  • If the balance is not enough, the renewal fails and the VPS stops when the period ends
  • We send email reminders before the period ends, but making sure your balance is enough is your responsibility

When the period ends:

  • VPS, APP & Windows and VPS EU: the VPS is stopped when the period ends and may be permanently deleted, with all its data, from 1 day later
  • VPS Core: the VPS and all its data are permanently deleted on the end date itself, with no grace period
  • Deleted data cannot be recovered. Renew your VPS before the end date to avoid losing data

The data deletion terms above apply specifically to VPS and replace the 30-day data retention term in the general Terms & Conditions.

4. Refund Policy

A VPS is a service that is provided immediately after payment. Therefore there are no refunds for cancellations due to a change of decision or needs on your part, including for:

  • Unused time left in the period, including when you delete the VPS before the period ends
  • Plan upgrade charges
  • Renewal charges, including automatic renewals
  • Moving to another plan, type or location
  • A VPS suspended or terminated for breaching these terms
  • Time during which the VPS is stopped for exceeding the traffic allowance
  • Incompatibility of the application, operating system or configuration you chose

Refunds are given in the following cases:

  • Creating the VPS fails and it never becomes active: the amount is refunded in full automatically
  • Helipod discontinues service in a location by its own decision: the unused period is refunded pro rata
  • The VPS cannot be used for more than 72 consecutive hours because of a disruption on Helipod's side (not caused by your actions, a breach of these terms, or force majeure): on your request, the unused period is refunded pro rata, up to a maximum of the One-Month Fee of that VPS
  • You reject a material change to these terms as set out in the Changes to These Terms section

The One-Month Fee is the price you paid for the VPS's current period divided by the number of months in that period. Example: a 12-month VPS bought for Rp 1,200,000 has a One-Month Fee of Rp 100,000.

Refunds are given as Helipod wallet balance. For refunds due to a disruption on Helipod's side or a discontinuation of service by Helipod, you may request a refund to a bank account in the account owner's name via support@helipod.io.

5. Upgrades, Downgrades & Reinstalls

  • A VPS plan can only be upgraded to a larger plan. Downgrading to a smaller plan is not available
  • Upgrade charges are calculated pro rata for the time left in the period and paid from your wallet balance
  • An upgrade may restart the VPS briefly
  • For VPS, APP & Windows, upgrades are only possible to another plan in the same location
  • Reinstalling the operating system erases all data on the system disk and cannot be undone
  • The number of snapshots per VPS is limited according to the plan

6. Blocked Ports & Sending Email

Port 25 (outbound SMTP):

  • VPS, APP & Windows: outbound connections to port 25 are blocked in every location and cannot be opened on request
  • VPS Core: port 25 is not blocked, but sending is limited to about 25 emails per minute. Regularly sending above that limit may get the VPS throttled
  • VPS EU (shared IP): because the IP address is shared, a VPS EU may not send email directly through port 25. Helipod may block this port at any time

To send email from your application, use an SMTP relay service on port 465 or 587, such as Helipod Email.

IP reputation:

  • You are responsible for the reputation of your VPS's IP address
  • Helipod does not guarantee that an IP address is free of blacklists and is not obliged to request delisting on your behalf

Ports blocked by network operators (VPS, APP & Windows): Some ports are often blocked by internet providers on the user's side, so services on the following ports may not be reachable from the internet. Avoid running public services on them:

  • TCP: 42, 135, 137, 138, 139, 445, 593, 1025, 1068, 1434, 3127–3130, 4444, 5554, 5800, 5900, 9996
  • UDP: 135–139, 1026, 1027, 1028, 1068, 1433, 1434, 5554, 9996

Firewall:

  • The ports open on your VPS are managed through the firewall or network settings in the Helipod dashboard
  • You are responsible for closing unused ports and securing the services you run

7. Traffic & Bandwidth

VPS, APP & Windows:

  • Each plan has a monthly outbound traffic allowance as stated in the plan description. Inbound traffic is not counted
  • The allowance resets every monthly period and does not carry over to the next month
  • If the allowance is exceeded, the VPS is stopped until the allowance resets in the next period, or until you upgrade the VPS to a plan with a larger allowance. The service period keeps running while the VPS is stopped
  • The peak bandwidth stated on a plan is not a guaranteed speed

VPS Core:

  • Inbound traffic is unlimited
  • Outbound traffic has no allowance and follows a fair-use principle. Continuously very high or disruptive usage may be limited to 100 Mbit/s

VPS EU (shared IP):

  • Bandwidth is shared with other VPS on the same server and the fair-use principle applies
  • Usage that disrupts other VPS may be limited without prior notice

8. IP Addresses

  • The IP address assigned to your VPS remains the property of Helipod or its network provider and is only lent to you for the VPS's service period
  • An IP address may change because of a reinstall, migration, maintenance or network changes. Helipod will try to notify you in advance when a change is planned, but is not liable for losses caused by an IP address change
  • An IP address cannot be transferred to another VPS or account, and is released when the VPS expires or is deleted
  • On a VPS EU (shared IP), the IP address's reputation is also affected by other VPS on the same server. Helipod may suspend a VPS that damages the reputation of the shared IP address

9. Prohibited Use

In addition to the prohibitions in the Fair Use Policy, a VPS may not be used for:

  • Proof-of-work cryptocurrency mining of any kind
  • Sending spam, bulk email without the recipients' consent, or phishing
  • DDoS attacks, port scanning, vulnerability scanning, or brute force against other systems
  • Running open proxies, public VPNs or Tor exit nodes
  • Running IRC servers
  • Storing or distributing malware, botnets or command-and-control servers
  • Pornography, child exploitation, online gambling, hate speech, or any other content that breaks Indonesian law or the law of the VPS's location
  • Distributing material that infringes copyright or trademarks, including pirated films, music or software
  • Programs that load the CPU, disk or network so heavily that they disrupt other VPS or our infrastructure

For security testing (penetration tests) of your own systems, ask Helipod for written permission first.

10. Windows Licensing

For a Windows VPS, the Windows Server licence is provided by Helipod as part of the service and is valid only for the VPS's service period. You must comply with the applicable Microsoft licence terms, including:

  • Not moving, copying or using the licence outside that VPS
  • Not removing, altering or circumventing Windows activation
  • Providing your own licences for Remote Desktop Services (RDS) if more than 2 users connect at the same time, and for other software such as Microsoft Office or SQL Server

11. Abuse Handling & Suspension

  • Abuse reports from third parties are forwarded to your account email
  • You must respond to and resolve an abuse report within 12 hours, including explaining the steps you took to prevent it from happening again
  • If there is no response within 12 hours, the VPS may be suspended until the problem is resolved
  • If you believe the report is wrong, send your objection with evidence within the same time limit. While the objection is being reviewed, the VPS is not suspended except for serious violations
  • For serious or clearly unlawful violations, Helipod may immediately suspend or delete the VPS and deactivate the account without prior notice
  • The service period keeps running while a VPS is suspended, and there are no refunds for a VPS suspended or terminated for a violation
  • Helipod may cooperate with law enforcement and provide account or VPS data as required by applicable law

Reselling VPS is only permitted with Helipod's written permission. If you resell VPS (as a reseller), you are fully responsible for how your customers use them, including responding to abuse reports.

12. Helipod's Access to the VPS

Helipod does not access the contents of your VPS in normal operations. The Helipod team may access your VPS only:

  • At your request or with your consent, for example for technical support
  • To handle a security incident, an abuse report or a disruption affecting other users or our infrastructure
  • If required by law or by an order of a competent authority

Every access is limited to what is necessary, logged, and not used for any other purpose. For access at your request, we will tell you what was done.

13. Backups & Data Responsibility

  • You have full root/administrator access and are fully responsible for the security, updates and configuration of your VPS
  • You are responsible for backing up your data regularly. Helipod is not liable for data loss, including from misconfiguration, attacks, reinstalls, or an expired VPS
  • Snapshots and daily backups (where available for your VPS) help with recovery, but do not guarantee that data can always be restored
  • Keep copies of important data outside the VPS

14. Availability & Maintenance

  • We work to keep your VPS available, but do not guarantee 100% uninterrupted service
  • Scheduled or emergency maintenance may restart a VPS or make it temporarily unreachable. For scheduled maintenance we try to notify you in advance
  • Basic DDoS protection is included, but not every attack can be mitigated. During a heavy attack, the targeted VPS may be temporarily disconnected from the network to protect other users
  • Compensation for a service disruption, if given, is Helipod wallet balance at Helipod's discretion

Limit of liability:

  • For any disruption, damage or data loss on a VPS, the total of refunds, compensation and damages from Helipod is at most the One-Month Fee of the affected VPS (see the Refund Policy section), however long the disruption lasts and however long a period you paid for
  • This limit does not apply to losses caused by Helipod's intent or gross negligence, or where applicable law does not allow such a limit

15. Restricted Regions & Compliance

A VPS may not be used by, or for the benefit of, parties in regions under international sanctions, including North Korea, Iran, Syria, Cuba, Sudan, Russia, Crimea, Donetsk and Luhansk. Helipod may terminate a VPS without refund if this is breached.

You must comply with the law of the Republic of Indonesia and the law of the country where your VPS is located.

16. Changes to These Terms

Helipod may change these terms, including the list of blocked ports, traffic allowances and available locations, to follow changes in infrastructure or regulation. Material changes will be announced by email and in the dashboard at least 14 days before they take effect, except for changes required by law or to deal with an urgent security threat.

If you do not agree to a material change, you may terminate the VPS before the change takes effect and request a pro rata refund of the unused service period via support@helipod.io. The change applies to you after its effective date only if you do not exercise that right.
